COLORADO HIGH COUNTRY EDUCATIONAL TREKS -Waiver and Release of Liability Agreement
In consideration of having access to participate in Colorado High Country Educational Treks programming sponsored by Colorado High-Country Educational Treks, I hereby understand and agree to this release of liability, waiver of legal rights, and assumption of risk and to the terms hereof as follows:
1. I acknowledge that Colorado Treks Programming involves recreational outdoor activities and that such activities are subject to mishap and even injury to participants. I understand and acknowledge that Colorado Treks Programming may be inherently dangerous that no amount of care, caution, instruction or expertise eliminates and I EXPRESSLY VOLUNTARILY ASSUME ALL RISK OF DEATH OR PERSONAL INJURY SUSTAINED WHILE PARTICIPATING IN Colorado Treks Programming WHETHER OR NOT CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTY.
2. I take full responsibility for, RELEASE AND HOLD HARMLESS Colorado High Country Educational Treks Inc, its directors, officers, employees, and agents (“Released Parties”) from any and all liability, claims, or causes of action that I may hereafter have for injuries or damages arising out of my participation in Colorado Treks Programming included, but not limited to, losses caused by the NEGLIGENCE OF RELEASED PARTIES.
3. I further agree that I WILL NOT SUE OR MAKE CLAIM against the Released Parties for damages or other losses sustained as a result of any injury, or death, sustained from my participation in Colorado Treks Programming. I also agree to INDEMNIFY AND HOLD THE RELEASED PARTIES HARMLESS from all claims, judgments and costs including attorney’s fees, incurred in connection with any action brought as a result of participation in Colorado Treks Programming by any of the undersigned.
4. I hereby expressly recognize that this Release of Liability, Waiver of Legal Rights, and Assumption of Risk is a contract pursuant to which I have released any and all claims against the Released Parties resulting from any injury, or death, sustained from participation in Colorado Treks Programming including any claims for negligence of the Released Parties.
5. I further represent that I am at least 18 years of age, I waiver and release any and all legal rights that may accrue to me as the result of any injury I may suffer while engaging in Colorado Treks Programming. Adult Participants (If signing for a minor, skip to Parent/Guardian Waiver below): BY CHECKING THE BOX BELOW, I ACKNOWLEDGE AND AGREE THAT I HAVE READ THIS RELEASE OF LIABILITY, WAIVER OF LEGAL RIGHTS AND ASSUMPTION OF RISK AND FULLY UNDERSTAND ITS CONTENTS. I SIGN IT OF MY OWN FREE WILL.
PARENT/GUARDIAN WAIVER FOR MINORS (under 18 years old)
The undersigned parent and/or legal guardian does hereby represent that he/she is, in fact, acting in such capacity, has consented to his/her child’s or ward’s participation in Colorado Treks Programming, and has agreed individually and on behalf of the child or ward to the terms of the Waiver and Release of Liability Agreement set forth above. The undersigned parent or guardian further agrees to save and hold harmless and indemnify each and all of the Released Parties referred to above from all liability, cost, loss, claim or damage whatsoever which may be imposed upon said parties because of any defect on lack of such capacity to so act and release said parties on behalf of the minor and the parents or legal guardian.
Media Consent Form:
In order to share this program with future participants, we would like to be able to use your image and likeness via our Colorado High-Country Education Treks website, social media, and YouTube, and other appropriate arenas.
1. I confirm that I have read and understand the Plain Language Statement for the above project and have had the opportunity to ask questions.
2. I understand that my participation is voluntary and that I am free to withdraw at any time, without giving any reason.
3. I agree to the following:
• Consent to interviews being audio-taped
• Consent to interviews being video-taped
• Consent to activities being video/audio taped
• Consent to all gathered materials to be used by Colorado High-Country Educational Treks for Public Relations purposes
